Civil rights chairman rebuffs Bush bid: Well, that's unique. A tussle between the commission and the president on exactly whose behavior is illegal, and why.
Thing is, the appointment letter is a smoking gun, as it were. With no record that the date was improper, and with a tame commission house council whose legal opinion will be considered suspect, and with the commission's enabling act saying not a word about recess appointments (which, actually, neither helps nor hinders), I can't see how Wilson and Berry have a legal leg to stand on.
And although I do agree with Berry about the role that the Civil Rights Commission should play, the fact is that it is NOT a government oversight committee of that sort. It's an executive branch commission, subject to the dictates of the president.
Won't it be fun watching federal marshalls descending on a federal office to seat a federal commissioner while possible arresting two others?
